Who we are

Pinch is managed by Alex Coady. Alex Coady will be referred to as 'we' from now on.

Information about you

We collect information about you in accordance with our privacy policy. Read it for detail on how and why we collect, use and share your personal data. By using Pinch, you agree that we will collect information about you in accordance with our privacy policy.

Using Pinch

You agree to use Pinch only for lawful purposes, and in a way that does not infringe the rights of, or restrict or inhibit the use and enjoyment of, the app by anyone else.

Pinch works on iPhones running iOS 16.4 or later and Android phones running Android 7.0 or later.

We may update Pinch automatically and regularly. We can change or remove features at any time without notice. Alternatively, we may ask you to update Pinch on your device. If you choose not to install updates, you may not be able to continue using Pinch.

Your account

You sign in to Pinch with Sign in with Apple or Google. You are responsible for keeping access to that account secure and must not share your Pinch account with any third party.

Your recipes and content

Pinch lets you add recipes by photographing them, pasting a link or text, or typing them in. You keep ownership of the content you add. By adding it, you give us permission to store, process and display it so we can provide the Service to you — including sending it to third-party services that read the recipe out of it.

You are responsible for the content you add. You must have the right to use it, and you must not add content that is illegal, abusive or infringes someone else's rights. Recipes from websites and books may be protected by copyright; Pinch is for your personal use and you must not use it to redistribute content you don't have the rights to.

Recipe extraction is automated and can make mistakes — quantities, timings and ingredients may be read incorrectly. Always check a recipe before cooking from it, particularly where allergies or food safety are concerned. We are not liable for any loss or harm arising from an inaccurately extracted recipe.

Scan credits and purchases

Reading a recipe from a photo, link or text uses scan credits. New accounts get some credits free, and you can buy more as one-off packs inside the app. There are no subscriptions.

Purchases are processed by Apple through the App Store, or by Google through Google Play, and are subject to their terms. We do not process payments or refunds directly — refund requests must be made through Apple or Google.

Credits have no cash value, can't be transferred to another account, and are only usable inside Pinch. If you delete your account, any unused credits, including ones you bought, are lost.

Pinch disclaimer

While we make every effort to keep Pinch up to date, the app is provided 'as is' and 'as available'. To the extent permitted by law, we do not provide any express or implied guarantees, conditions or warranties that Pinch will be:

• suitable for your individual requirements
• available or uninterrupted
• current or accurate
• free from errors, bugs or viruses

Payment of any fee does not entitle you to compensation for any period of unavailability or service interruption.

Except as otherwise expressly stated in these terms, we are not liable for any loss or damage that may come from using Pinch. This includes any direct, indirect or consequential losses; any loss or damage caused by civil wrongs ('tort', including negligence), breach of contract or otherwise; and the use of or inability to use Pinch. This applies whether or not the loss or damage was foreseeable, and includes but is not limited to loss of income, revenue, business, profits, contracts, opportunity, anticipated savings, data, goodwill, reputation, or tangible or intangible property.

We may still be liable for death or personal injury arising from our negligence, fraudulent misrepresentation by us, and any other liability which cannot be excluded or limited under applicable law.

Security and prohibited behaviour

When using Pinch, you must not:

• use Pinch in any unlawful manner or for any unlawful purpose
• introduce viruses, trojans, worms, logic bombs or any other malicious or technologically harmful material
• attempt to gain unauthorised access to Pinch, the servers on which it runs, or any connected systems or databases
• attack Pinch in any way, including denial-of-service attacks
• scrape or harvest data from Pinch or its underlying services
• attempt to reverse engineer, decompile or create derivative works based on Pinch
• infringe our intellectual property rights or those of any third party
• use Pinch in a way that could damage, disable or impair our systems or interfere with other users

We will report unlawful acts or attempts to gain unauthorised access to the relevant law enforcement authorities and share information about you with them.

Use by children

Pinch is not designed for or intended to be used by children. You should not use Pinch if you are under 13, nor allow any child under 13 to use the app on your device.

Ending your rights to use Pinch

We may end your rights to use Pinch at any time if you are in breach of these terms. We may, but are not bound to, give you a reasonable opportunity to remedy the breach. If we end your rights, you must stop using the app immediately and delete it from all devices in your possession.

Governing law

These terms are governed by and construed in accordance with the laws of England and Wales. If you live in England or Wales, you can bring legal proceedings in the English or Welsh courts; in Scotland, in the Scottish or English and Welsh courts; in Northern Ireland, in the Northern Irish or English and Welsh courts.

General

We are not liable if we fail to comply with these terms because of circumstances beyond our reasonable control. If we choose not to enforce a right under these terms, we can still enforce it later. If any of these terms are held to be invalid, unenforceable or illegal, the remaining terms still apply.

Changes to these terms

The latest version of these terms will always be accessible in Pinch and on this page. We can update them at any time without notice. Your continued use of Pinch after any update constitutes your agreement to the updated terms.
